Preparation to develop tenancy as a business, government took important decision



Model Tenancy Act: In the Model Tenancy Act, it is proposed to create relevant authorities in the states. State governments will also be able to set up rent courts and rent tribunals for speedy resolution of any dispute regarding rental properties.

New Delhi:  Big news has come for the people living in the rented house. The Model Tenancy Act was approved in the cabinet meeting chaired by Prime Minister Narendra Modi on Wednesday. The draft Model Tenancy Act will now be sent to the states and union territories. This can be implemented by making a new law or by making necessary amendments in the existing tenant law.

In fact, in the Model Tenancy Act, there is a proposal to create a related authority in the states. State governments will also be able to set up rent courts and rent tribunals for speedy resolution of any dispute regarding rental properties. According to a statement issued by the government, this will help in revamping the legal framework with regard to renting out houses across the country, thereby paving the way for further development of the sector.

TENANT WILL GET MANY RIGHTS

The right to implement this law will be on the states. With the creation of a new law, the tenant as well as the landlord will get many rights. If there is a dispute between the owner and the tenant of the house or property, then both will get the legal right to resolve it. No one can take possession of anyone's property. Even the landlord cannot harass the tenant and ask him to vacate the house. Necessary provisions have been made for this.

BENEFITS OF THE NEW LAW

The Tenancy Act aims to create a diversified, sustainable and inclusive rental housing market in the country. This will help in creating a stockpile of adequate number of residential units for rent for people of all income groups and will solve the problem of homelessness. With the new law, vacant houses will be made available on rent.

TENANCY BUSINESS

The government hopes that through this private participation will increase in developing the tenancy market as a business, so that the acute shortage of residential houses can be met. The Model Tenancy Act will help in institutionalizing the residential rental system.

  3. The Creation of special tenancy courts will be the biggest drawback. Chances of getting justice as per law will be almost zero. These special courts will be politician appointed courts and No Justice can be expected from them.

  4. But about old commercials PAGRI systems who already paid Market Value amounts to Landlords. It was the system and not allowed a part Registry was defect in the LAW. SO to Save pagri tenants, by REMOVING Section 47.in MODERN TENANCY ACT.

  5. Its only 5 to 10% disputes arise and out of it amicability also settled with mediators and agents quietly. Introducing 2 months rent as advance and Four times the rent after the 1st month payable by the tenant is not practicable for both. Earlier Karnataka Govt reduced the time bound procedure of 10-11 years to 30 months which is being followed be reduced to 24 months. The court fee may be enhanced considerably to make the Tenant and Land Lord for reluctance
