New Pension Rule: The rules of family pension have changed, the government has cleared the confusion on these changes

 


The Department of Pension and Pensioners' Welfare has said in a memorandum that applications have been received from two different sources seeking clarification regarding eligibility of family pension in respect of the same employee/pensioner. For example, separate pension is being sought in respect of the service rendered by the soldiers in the army and their service rendered in the civil service or autonomous bodies and civil government departments after retirement from the army.

New Delhi.  The central government has amended the rules of pension. This change has been made in the case of family pension. The Department of Pension and Pensioners' Welfare has issued clarification regarding the right to family pension from two different sources.

The Department of Pension and Pensioners' Welfare has said in a memorandum that applications have been received from two different sources seeking clarification regarding eligibility of family pension in respect of the same employee/pensioner. For example, in relation to the service rendered by the soldiers in the army and their service in the civil service or autonomous bodies and civil government departments after their retirement from the army. The department has issued this clarification on 23 May.

These amendments in pension

The Central Civil Services (Pension) Act, 1972 has been replaced by the Central Civil Services (Pension) Act, 2021. It has been notified on December 20, 2021. Section 50 of this law deals with family pension. In this, there is no restriction on family pension from two different sources. Regarding this, the Pension Department has issued a clarification. The Government has clarified that there is no restriction in the Central Civil Services (Pension) Rules, 2021 for grant of family pension from two different sources to a member of the family in respect of a Government servant/pensioner.

However, after the death of two different employees/pensioners, the eligibility of two family pensions to one member of the family will remain restricted. This means that if both the husband and wife are pensioners and on the death of one of them, the benefit of half the pension that the other gets will not get as before.

This change happened earlier.
Earlier, the Central Civil Services (Pension) Rules, 1972 were amended on December 27, 2012. Sub-rule 13A of Rule 54 prohibited the grant of family pension to military pensioners. This restriction was applicable if a military pensioner had opted for family pension for his military service. Similarly, sub-rule 13-B of rule 54 prohibited the grant of two family pensions to a person who was already in receipt of family pension. Even if he was eligible for pension under any other rules of the Central or State Governments.
