Student Visa Cancellation in America: If any member of your family is on student visa in America, then this is important news because visas of 327 students have been cancelled, of which 50% are Indians.

Student Visa Cancellation in America: If anyone from your family has been on a student visa in America, then this news is important for you. According to the report of the American Immigration Lawyers Association (AILA), recently the visas of 327 international students have been canceled or their SEVIS records have been terminated. About 50% of these students are Indians.

AILA said that 14% of these students are from China. Apart from this, students from countries like South Korea, Nepal and Bangladesh have also come under the grip of this action. According to a report by the Indian Express, according to the data of Open Doors, 3.32 lakh Indian students are studying in the US in the year 2023-24, which is 29% of the total international students there. China is in second place.

Big impact on students living on OPT

What is OPT?

Optional Practical Training (OPT) is a facility that allows students to work for some time after completing their studies in the US. It is usually for 12 months, but for students with STEM (science, technology, engineering, mathematics) majors, it can be extended to 24 months.

According to AILA, 50% of the students whose records were cancelled were on OPT. It is more difficult and unclear for these students to restore their status as compared to students who are just studying. According to the data for the year 2023-24, about 97,556 Indian students were on OPT, which is about 29% of the total number of Indian students.

What is the reason behind visa cancellation

Contact with police and minor violations

AILA said that many students faced trouble due to interaction with the police on minor issues. This includes the following.

Speeding ticket

Driving without a license

Driving drunk

Accidentally forgetting to scan an item from the store

Drinking alcohol at an early age

What did the data reveal?

65% of the Indian students whose visas were cancelled were on OPT. 87% of Indian students reported that they had some form of interaction with the police. In 34% of cases, no case was registered against the students or they got relief from the court.

Why is it serious to have a SEVIS record expunged?

SEVIS is a U.S. government database that contains records of every international student. If the record is expunged, the following problems may arise.

The student’s F or M visa status is considered terminated.

He cannot work.

He cannot re-enter the United States.

ICE agents may monitor the student.

Fear and uncertainty among students

Congress leader Jairam Ramesh raised the issue on social media and appealed to Foreign Minister Dr. S Jaishankar to pay attention to it. He said that the reasons for canceling the visa are unclear and this is creating an atmosphere of fear among the students. At the same time, Foreign Ministry spokesperson Randhir Jaiswal said that he is aware of this situation and the Indian Embassy and Consulate in the US are helping the students.

According to the AILA report, clear reasons were not given in most cases and many students only received notices from their university. Only 14% of the students received official information from ICE. AILA says that this situation is very disturbing for foreign students and there is arbitrariness in it.
