The Central Board of Direct Taxation (CBDT) has notified new income tax return forms — ITR-1 to ITR-7 — for the assessment year 2021-22, the ministry of finance said in a release on 1 April. “Keeping in view the ongoing COVID-19 crisis and to facilitate the taxpayers, no significant change have been made to the ITR forms in comparison to the last year’s ITR forms,” the CBDT said. Only the bare minimum changes necessitated due to amendments in the Income-tax Act, 1961 have been made, CBDT further added.

The taxpayers will now have dedicated space in each of the ITR forms — Sahaj (ITR-1), Form ITR-2, Form ITR-3, Form ITR-4 (Sugam), Form ITR-5, Form ITR-6, Form ITR-7 and Form ITR-V to describe their investments, CBDT said.

ITR Form 1 (Sahaj) and ITR Form 4 (Sugam) are simpler Forms that cater to a large number of small and medium taxpayers. Sahaj can be filed by an individual having income upto ₹50 lakh and who receives income from salary, one house property/other sources (interest etc.)

“Similarly, Sugam can be filed by individuals, Hindu Undivided Families (HUFs) and firms (other than Limited Liability Partnerships (LLPs)) having total income upto Rs. 50 lakh and income from business and profession computed under the presumptive taxation provisions, the statement mentioned. Both the ITR forms are however not meant for individuals who are either director in a company or has invested in unlisted equity shares.

Individuals and HUFs not having income from business or profession (and not eligible for filing Sahaj) can file ITR-2. Those having income from business or profession can file ITR Form 3, it further stated.

“Persons other than individual, HUF and companies i.e. partnership firm, Limited Liability Partnerships (LLP) etc. can file ITR Form 5. Companies can file ITR Form 6. Trusts, political parties, charitable institutions etc. claiming exempt income under the Act can file ITR-7,” the statement noted.

The notified ITR forms are available on egazette.nic.in. There is no change in the manner of filing of ITR forms as compared to last year, the tax body mentioned.

Commenting on the new ITR forms, Archit Gupta, founder and chief executive officer, Cleartax said, “This year’s ITR forms do not have any major changes, as it should be, there should be as little change as possible so taxpayers find it easy to comply and are able to report information consistently.”

“Besides the choice between the regimes, taxpayers need to report quarterly dividend income earned in FY 2020-21 in order to comply with advance tax provisions similar to how advance tax is calculated and paid on capital gains, he explained.

“Tax filing exercise this year will be very important for every single taxpayer as this is the first time that taxpayers will have the option to choose a more beneficial tax regime,” he further added.

Meanwhile,the Income Tax Department has issued refunds worth over ₹2.62 lakh crore to more than 2.38 crore taxpayers in 2020-21. This include ₹87,749 crore personal income tax refunds to 2.34 crore taxpayers and ₹1.74 lakh crore worth corporate tax refunds in 3.46 lakh cases. The refunds issued in 2020-21 marks an increase of almost 43.2%, the I-T department said in a statement.

    1. I dont know if i am the only person feeling like this. But i should confess filling ITR 2 is one of the most difficult task which in my viewnot even 1% tax payers can do by themselves. ITR 2 doesnot open in my laptop but opens in my friend's. He says it requires original Microsoft ( not pirated versions) .i am not sure.
      2. i sat with an income tax practioner and together we struggled to fil capital gains entires. At the end the tabulation showed more Loss than my own caliculation probably because it is showing Indexation which is not applicable in my case.
      3. I approached auditors, but they are so busy with GST work and are least interested in salary/ capital gain returns ). I have been struggling for last many yrs to know how to calculate capital gains /losses. Each person tells a different rule.
      4. Now with addition of quarterly dividend calculation for the purpose of calculating advance tax , life will be miserable for genuine tx payers. Because last yr most banks didnot show explanation in customer's transactions. Noway to know what those small credits in accounts are.
      I am fed up with present finance minister because ITR filling has become extreemly difficult for anybody indulging in stock trade eeven on small scale. Auditors are charging heavy fee irrespective of the profit/loss one gets by trading. I am not talking abt speculation.
      sorry fr venting my grievance.

  23. I am a very senior citizen [92}. As per recent Govt regulations, I am not supposed to file my IT-1 return. I am a central Govt pensioner and whatever investments I made in MF are solely from my pension amount. No outside money is involved. In ITR-1, in deduction portion, Firstly, there is no provision to include deduction of Rs 30000/- for self owned and occupied property maintenance, Secondly, there is also no provision to include deduction of Rs 1,00,000/- as exemption towards Captial Gains and Dividend income. Thirdly, Senior Citizens medical expenditure of Rs 1,00,000/- has been given but with specified case is mentioned, which is not for OPD exemptions, how?

    I filed my IT return for AY 2021-22 in the month of August 2021. Though I paid advance tax of Rs 2 lakhs, still the total tax worked out more by Rs 3580. I paid this amount on 23-8-2021 and requested the IT dept. to acknowledge the receipt of this amount and that no outstanding dues are pending against me. In spite of number of reminders IT dept has not replied. I also asked them to refer to 26AS where this payment has been indicated. Such a simple thing but IT dept does not bother. What I am supposed to do.

  79. Firstly I am earning for myself and my family, not to pay someone for free in the name of TAX. Since its government mandate, I want to mention 2 things here.

    1. You need tax from me, so you make it so simple that I can just do it without any hassle going post to pole to get some CA or professional Tax practitioner and pay him another few thousands to enable me to pay you right amount.

    2. If a person is paying tax and he looses his job or lost his life and after 9-10 months of paying TDS etc and after him there is no one to feed his family and pay fees to his kids, will the tax department refund him the money he paid till date as tax though out his life for the sake of his and his family's future? If there is no social security to the tax payer then he will obviously look for ways to save more for his future.

    I would advise the tax department

    1. Should announce that any person pays direct tax will get social security such that the tax payer will get 10% of his last tax paid as monthly income in case of any unforeseen circumstances anytime before the age of 60. This can be availed 3 times in any ones life time.

    2. Should give privileges' to the tax payer by ensuring discounts and/or priority access, like in credit cards. If a tax payer books flight tickets he should get instant discount of 20% on prevailing rates, or get confirmed tickets in trains etc. The more you pay the more you get the benefits.

    If you threaten the tax payer he will run away like Malaya or any other business men flew from the country.

    Sub: Union Budget 2020-21 Suggestion for introducing "Unemployinent
    Ingurance/Allowance"

    The salaried class, in general, are the honest income taxpayers. The Government Employees
    and Public Sector employees are having the pensionary benefits. A number of employees in
    the Private Sectors, particularly the I.T. Sector employees are fairly well paid and most of
    them belong to the highest tax bracket and contribute about 1/3d of their income as taxes.
    During the recession period, some of the establishments are wound up or liquidated and the
    employees lose jabs leading to severe financial crunch and some are thrown to streets.

    Since they have loyally paid sizeable portion of their income as income tax, the Governmem
    needs to do something during the time of their distress. The Government gives several
    freebies to the low-income group citizens, subsidizing crores of rupees to corporates in times
    of recession, loans of farmers affected due to drought/cyclone are compensated for the loss
    and Bank NPA's are written off. It is equally obligatory and pressing for the Government to
    take care of the retrenched employees of the Private/Public Sector by providing them some
    relief as unemployment insurance/allowance particularly because of the "labor policy
    moving from "assured tenure' to the "hire and fire" policy.

    The Government may build a corpus by way of apportioning some percentage of Income Tax
    paid by the employees of Private Sector for covering the outgo for the purpose of providing
    some subsistence allowance to those who were thrown out of the job and until they get
    alternative employment. Alternatively, the Govt. may levy some surcharge/cess as is
    collected for educational purposes. This subsistence allowance should not be considered or
    equated wlth the unemployment dole belng pald to unemployed persons waiting for
    employment after passing school/college education as they are yet to start their careers.

    This is not just a suggestion but a necessity to contemplate for providing succor to those who
    contributed to the National Revenue.
